Terms of Service

You must be at least 18 years old to use Popcasso. By using the Service you represent that you meet this requirement and that the information you provide during registration is accurate and kept up to date.

You are responsible for maintaining the confidentiality of your login credentials and for all activity that happens under your account. Notify us at lucas@neoquest.tech promptly if you suspect unauthorized access. We may suspend or terminate accounts that violate these Terms or that put the Service or other users at risk.

Popcasso provides editorial intelligence for indie fiction authors — a multi-agent editorial team that gives notes, line edits, and structural feedback on your manuscripts. The Service is governed by these Terms and our Privacy Policy.

The Service is offered as-is and is under active development. Features, pricing, and usage limits may change. We will give reasonable notice of material changes that affect you.

You retain all ownership rights in the manuscripts, notes, and other content you create or upload to Popcasso (“Your Content”). You grant Popcasso a worldwide, non-exclusive, royalty-free license to host, store, copy, transmit, process, and display Your Content solely for the purpose of operating, providing, securing, and improving the Service for you. This license ends when you delete Your Content or close your account, except for backups retained for a short period as part of normal operations and as required by law.

You represent that you have the rights necessary to grant this license and that Your Content does not infringe any third party’s rights or violate any law.

Popcasso uses large language models to generate editorial feedback on your manuscripts. These outputs are suggestions based on patterns in your draft, not guarantees about how readers will respond. Use the outputs as one signal among others — your own judgment, your readers, and real-world testing should drive final creative decisions.

You are responsible for the work you ultimately publish and for ensuring it complies with applicable law.

You agree not to:

• Use the Service to create, store, or distribute content that is illegal, defamatory, harassing, or that exploits minors.
• Attempt to access another user's account or manuscripts.
• Reverse engineer, decompile, or attempt to extract the source code or model weights of the Service.
• Scrape, mirror, or programmatically extract data from the Service except via interfaces we expressly provide.
• Use the Service to build a competing product, or to train machine-learning models on Popcasso outputs without our written permission.
• Interfere with the Service, bypass rate limits, or transmit malware or any code intended to harm the Service or its users.

Popcasso may offer paid plans. If you subscribe to a paid plan, you authorize us (and our payment processor) to charge the recurring fees described at checkout until you cancel. Fees are non-refundable except where required by law. We will give reasonable advance notice of price changes that affect renewals.

You can stop using Popcasso at any time and request account deletion by emailing lucas@neoquest.tech. We may suspend or terminate your access if you breach these Terms, if your usage poses a security or legal risk, or if we discontinue the Service. On termination, your right to use the Service ends and the data-deletion process described in our Privacy Policy applies.

Popcasso, including its software, models, design, brand, and documentation, is owned by us and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service in accordance with these Terms. All rights not expressly granted to you are reserved.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WITHOUT LIMITATION ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. WE DO NOT WARRANT THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY AGENT-GENERATED FEEDBACK.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, POPCASSO AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, LOST DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) R$500.

You agree to defend, indemnify, and hold harmless Popcasso from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your use of the Service, Your Content, or your breach of these Terms.

These Terms are governed by the laws of the Federative Republic of Brazil, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Service will be resolved exclusively in the courts of São Paulo, SP, Brazil, except where applicable consumer-protection law allows you to bring an action in your local jurisdiction.

We may update these Terms from time to time. If we make material changes, we will update the effective date at the top of this page and, when appropriate, notify you through the Service or by email before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
